Court date set for squabble over 61 land|[7/13/05]

An eminent domain case scheduled to be heard today has been postponed until September.

The case was brought by the Mississippi Department of Transportation against members of the Fowler family of Vicksburg and Shannon Farms, also of Warren County, seeking to take a tract of land along U.S. 61 just north of the Yazoo River Bridge at Redwood, according to records in the Warren County Circuit Clerk’s Office.

“It is my understanding (the commission) is planning to widen U.S. 61 North and the bridge,” said Gerald Braddock, a Vicksburg attorney acting as special counsel for the state.

Warren County Court Judge Johnny Price, acting as the judge of the court of eminent domain, has already granted the Mississippi Transportation Commission title to the land and the only difference between the landowners and the commission is how much the landowners will be paid for the land, Braddock said. A jury trial to decide the issue is scheduled for Sept. 14.

Walter Lyons, district engineer for MDOT, said the department has the letting of a contract to build the new two-lane, high arch bridge in September, but added that could be delayed. The bridge is estimated to cost $30 million.
