Lawyer, business owner reindicted in drive-by|[5/23/06]

Madison County authorities have changed the charges against a Vicksburg business owner who also has a law practice in Jackson.
Judith Kristie Smith now faces trial on conspiracy and accessory-after-the-fact charges. A year ago she was charged with aggravated assault in a drive-by shooting in Ridgeland that left another woman injured.
“She has, in fact, been reindicted,” Madison County Circuit Clerk Lee Westbrook said today.
The trial for Smith, 38, of 132 Pebble Beach Drive is scheduled for Nov. 21.
She and a business partner, Thomas Randy Clark Jr., 34, 109 Hillside Circle, were arrested May 22, 2005, after a Brandon woman was wounded following a brief argument in the drive-through lane at a Krystal on County Line Road.
Charged with two counts of aggravated assault and one count of drive-by shooting, Clark pleaded guilty in an April hearing and said he had fired the shots, then disposed of the weapon. He also claimed sole responsibility and said Smith had tried to talk him out of firing 9mm handgun. He is scheduled to be sentenced June 5.
That plea undercut the evidence against Smith, who faced the same counts. The new charges indicate prosecutors believe she was not a mere passenger, but participated with Clark in or after the crime.
According to police reports, Flowood resident Susan Wiltshire, then 22, was in the drive-through lane when the car she was driving was hit from behind by a Jaguar driven by Clark. They argued before both cars left on Old Canton Road.
Shots from a semiautomatic weapon were reported after the Jaguar caught up with the Toyota driven by Wiltshire. One shot hit Wiltshire in her left side.
Two passengers, then-19-year-olds Elizabeth Wiltshire and Joseph Turnage, were not injured.
Clark and Smith were arrested by Ridgeland police at Harbour and Lake Harbour drives, according to police reports. Smith was reportedly driving when they were stopped.
Both were released the same day on $5,000 bonds. But three days later, bonds set for the drive-by shooting charge were increased to $50,000 each and both were charged with two counts of aggravated assault, which carried bonds of $150,000 each. They each posted $200,000 bail and were released a second time.
Smith, who continues to be free on bond pending the trial, operates Smith-Miller, Boone and Associates in Jackson and also owns Frogs and Faeries and Manicures, Martinis & Magic in Vicksburg. If convicted, she could face up to 10 years in prison and would be disbarred, as is required by state law.
