Tenn. drops federal charge against escapees Two still face kidnapping, death prosecution in Mississippi

MEMPHIS, Tenn. — Federal charges against two Louisiana prison escapees suspected in a fatal carjacking that started in Vicksburg and ended in Memphis were dropped Friday, though the men still face extradition to Louisiana and Mississippi.
Court documents from the Middle District of Louisiana show that a federal charge of unlawful flight from prosecution has been dismissed for both Darian “Drake” Pierce, 33, and Ricky Wedgeworth, 36. The men were arrested Monday, 10 days after authorities said they escaped a Zachary, La., police barracks in a stolen van and ended up in Vicksburg, where they are accused of carjacking David M. Cupps, a 53-year-old Ohio man who was in town on business.
The Tennessee state charges of simple escape and unauthorized use of a motor vehicle remain in place. They now face extradition for Louisiana charges — escape from a correctional facility and theft of a vehicle — filed in the 19th Judicial Circuit of East Baton Rouge Parish.
The two are also to be transferred to Mississippi to face a federal charge of kidnapping resulting in death that will be prosecuted by the U.S. Attorney’s Office in Jackson.
Vicksburg Police Lt. Bobby Stewart said Friday night that no date had been set for the two to arrive in Mississippi, but they would likely be brought here before heading to Louisiana.
“If I have anything to do with it,” he said, “they will stay in Mississippi.”
Pierce made a court appearance in Memphis on Friday. During the hearing, federal prosecutor Fred Godwin told U.S. Magistrate Judge Edward Bryant of the dropped federal charge and of the extradition plans.
Godwin said the men were being transferred to the custody of the Shelby County Sheriff’s Office in Memphis, pending extradition.
Pierce and Wedgeworth were caught after police chased them from Olive Branch, Miss., into Memphis on Monday.
Earlier that day, authorities said, they tied up a Jackson, Tenn., parks worker and stole his truck.
While on the run, authorities say the two on March 7 carjacked and later killed Cupps, of Sunbury, Ohio, who had been staying in Vicksburg while on a business trip to Grand Gulf Nuclear Power Station in Claiborne County. Cupps’ body was found at a hotel in Bessemer, Ala., on March 9.
His funeral was Friday in Ohio.
Wedgeworth was serving time in Louisiana for armed robbery, and Pierce for attempted second-degree murder.
