City board pockets pool table decision|[3/13/06]

It has been two months since Michael Gates was denied by the Zoning Board of Appeals to continue having a pool table in his store, Gates Express Mart, 1814 Sky Farm Ave., and he still does not know whether the table will be there in the future.

Gates went before the City Board of Mayor and Alderman on appeal Friday, but the board tabled the issue until it could receive more information.

Mayor Laurence Leyens said the only way he could vote to allow a nonconforming use of the pool table was if the table was on the premises before the zoning laws were created in 1971.

Gates was denied a special exception from the Zoning Board in a 5-1 vote on Jan. 10, because his business is located in a C-1 neighborhood commercial zone where pool tables are not allowed.

Gates brought a petition including names of people who want the pool table to remain. Another petition was submitted to the board, however, with names of people wanting it removed.

The City Board will readdress the issue at its next meeting March 20.
