A former Vicksburg resident and business owner is being held in the Sunflower County Jail on a civil warrant for contempt of court pending a chancery court hearing involving a court-ordered settlement she has to pay to her ex-husband.

A source familiar with the case said Tammy Carol English, the former owner of Good Samaritan Physical Therapy, is expected to have a hearing Thursday in Sunflower Chancery Court concerning her ability to pay the settlement, which totals more than $1 million.

English appealed the chancellor’s order to the Mississippi Supreme Court, and the court upheld the chancellor’s order.

The source said English, who had been working in Louisiana as a physical therapist, was arrested last week in Madison County, where she had gone to eat. The warrant was discovered during a records check at a traffic stop, and she was arrested and transferred to Sunflower County.

Although the divorce was filed in Warren County, the case was transferred to the Sunflower County chancellor because the Warren County chancery judge claimed a conflict of interest, the source said. The file was sealed on the presiding judge’s order, according to Warren County chancery clerk’s records.

According to the Supreme Court decision, English was ordered to pay her ex-husband Dane Davenport $1.5 million in installments of $8,421.75 a month for 180 months. Davenport owned 25 percent of Good Samaritan Physical Therapy and the couple owned two homes and a condominium, according to the court record.

English, the source said, fell behind in her payments and failed to meet certain court-mandated deadlines, resulting in the civil contempt warrant.

According to Supreme Court documents, Davenport, a state trooper, filed for divorce in 2007, citing habitual cruel and inhumane treatment. English, according to the facts outlined in the decision, claimed she discovered Davenport molesting one of her sons from a previous marriage.

Davenport was later charged with one count of sexual battery in Okatibbeha County and nine counts of sexual battery in Warren County. He was found not guilty in the Okatibbeha case. A Warren County jury found him not guilty on five of the nine sexual battery counts, but was unable to reach a unanimous verdict on the other four.

The remaining charges were later dismissed with prejudice by the Attorney General’s office, meaning the four cases cannot be tried again.

Besides owning Good Samaritan Physical Therapy, English was head of the Aquila Group, a local initiative formed in 2007 with the city to bring a $25 million sports complex to Halls Ferry Park. The deal later fell through.
